The redline
as at 2018-06-30
Not in the Act before this amendment: the amending Act inserted the provision. Section 2 of Act 9 of 2018 also inserted the definition of over the top services: the transmission or receipt of voice or messages over the internet protocol network, including access to virtual private networks.[ACT-EDA-2018-9, PDF page 2, ss. 2 and 6(g)]
as at 2018-07-01
Inserted: Over the top services: Ushs 200 per user per day of access;Verified law: Wording or a date read in a statutory text, with the version and page named.[ACT-EDA-2018-9, PDF page 7, s. 6(g)]
Act 9 of 2018 created the charge: it inserted the definition in s. 2, the operator's liability in s. 4(5) and the daily rate in item 13(b). There was no earlier wording to strike.
In plain English
Interpretation: A reading of the evidence, by a named source or by this register. Anyone reaching social media or messaging apps through a mobile network owed a flat daily charge, collected by the operator. Users could, and did, route around it.
Reason
Rationalise excise related telecommunication services and enhance compliance
Interpretation: A reading of the evidence, by a named source or by this register. [MOF-CG-1819, printed page 7, PDF page 10]
Marked as interpretation: the source states this objective, but either does not tie it to this measure in so many words or is not the Ministry that proposed it.
Policy objective as classified by the register: Widen the base. Intended revenue direction: raise.

Observed change
Observed: A value or event as an official source records it, copied without calculation.- Collections for the tax heads affected are drawn on the story page, from URA's annual data books. Before and after is never presented as this amendment's effect.
- Rung 2
Official forecast
Official forecast: What MoFPED or URA said a measure would raise, or why it was made, before the year began.- MoFPED: UGX 284 bn expected in FY2018/19 (Daily excise duty of UGX 200 on over-the-top (OTT) services).[MOF-CG-1819, printed page 8, PDF page 11]
- URA: UGX 284 bn expected in FY2018/19 (Daily excise duty of UGX 200 on over-the-top (OTT) services).[URA-ARR-1819, printed page 18, PDF page 24, Figure 15]
- Rung 3
Reported yield
Reported yield: What URA attributes to a measure after the year. An official attribution, not a causal estimate.- URA reports UGX 49.52 bn for FY2018/19, 17.44 percent of the forecast (computed).[URA-ARR-1819, printed page 18, PDF page 24, Figure 15]
- Rung 4
Static or modelled estimate
Modelled estimate: A mechanical or model calculation, with every assumption shown.Missing. No estimate made. A static estimate needs the taxable base before the change (volumes or values by product), which the register does not hold.
- Rung 5
Causal estimate
Causal estimate: An effect identified by a stated research design against a comparison group.Missing. No study with a defensible identification strategy was found for this amendment.
- Rung 6
Wider impact
Interpretation: A reading of the evidence, by a named source or by this register.- URA attributes the shortfall to the use of Virtual Private Networks, which avoid the daily charge, and to users giving up social media access.[URA-ARR-1819, printed page 18, PDF page 24]
What is known, what is uncertain, and what would settle it
- Known: official forecast, reported yield, wider impact.
- Uncertain: static or modelled estimate, causal estimate; and 1 open point below.
- Would settle it: Request to the Clerk to Parliament for certified copies of the Excise Duty, Income Tax, Value Added Tax, Stamp Duty and Tax Procedures Code (Amendment) Acts of 2015 to 2025, with their dates of assent and Gazette notice numbers. Held by Uganda Printing and Publishing Corporation (Uganda Gazette); Parliament of Uganda Library; ULII.
- Would settle it: Request to UBOS for item-level CPI prices for the affected goods from FY2014/15 to FY2024/25. Held by Uganda Bureau of Statistics (CPI micro-prices, Uganda National Household Survey).

- amendment: verified. The provision is read in the ULII consolidated text.
- mechanism: verified. A new charge on a base not taxed before.
- implementation: verified. URA reports performance for the measure, so it was applied.
- response: verified. URA documents avoidance through VPNs and users giving up access.
- outcome: verified. URA reports a yield. It is an official attribution, not a causal estimate.
- wider: hypothesised. Effects on internet use and on small businesses that sell through social media are plausible but were not measured in any source read.
Consequences
Graded against ten criteria. No composite score: a reform that raises money can still be regressive or costly to comply with, and one that loses revenue can serve a legitimate aim. Revenue effectiveness is graded by a stated rule; the rest only where a source speaks to them.
What worked
No criterion graded effective on the evidence read.
What did not
Revenue effectiveness
Reported yield over MoFPED's forecast for FY2018/19: 17.4 percent.(graded by rule)
Ineffective
Administrative feasibility
A per-day charge collected through operators could be bypassed by VPN access, which URA reports as a high avoidance rate.[URA-ARR-1819, printed page 18, PDF page 24]
Ineffective
Unintended consequences
URA's own account is that users avoided the charge through VPNs or gave up access, so the design invited the avoidance that defeated its revenue aim.[URA-ARR-1819, printed page 18, PDF page 24]

- Interpretation: A reading of the evidence, by a named source or by this register.URA attributes the shortfall to the use of Virtual Private Networks, which avoid the daily charge, and to users giving up social media access.[URA-ARR-1819, printed page 18, PDF page 24]
Afterlife
Later changes, cases and practice
- Observed: A value or event as an official source records it, copied without calculation. The OTT series in the URA data books ends after FY2020/21.[REPO-EXCISE]
- Verified law: Wording or a date read in a statutory text, with the version and page named. The current Act still makes operators liable for excise on access to over-the-top services (s. 3(5)), while Schedule 2 taxes internet data at 12% of the fee (item 13(b)). Whether and when the data charge replaced the daily charge is pending verification.[ULII-EDA-2025, PDF page 16, Schedule 2, item 13(b)]
- Observed: A value or event as an official source records it, copied without calculation.URA assessed MTN Uganda for UGX 33,911,117,000 of unpaid duty on over-the-top access for April 2020 to June 2021, counting accesses from a government-contracted network monitoring system. On 30 June 2026 the Tax Appeals Tribunal set the assessment aside by a majority: the Act taxed access per user per day but set no technical test of access, and URA's method did not reliably separate paid, blocked and unpaid access. One member dissented.[TAT-2023-134, printed page 69 to 73, PDF page 69]
Before the Tribunal and the courts
MTN Uganda Limited v Uganda Revenue Authority Application No. 134 of 2023, [2026] UGTAT 46
Tax Appeals Tribunal, 30 June 2026
Application allowed by a majority, with costs; the assessment set aside, the objection decision vacated and the statutory deposit to be refunded. The Tribunal held that the taxable event was access to over-the-top services, charged per user per day, not network activity generally; that the law set no technical test of access; and that URA's method, built on monitoring data captured before blocking controls, a 1KB threshold with no statutory basis, and no reconciliation with the operator's payment records, did not reliably identify that event. One member dissented and would have upheld the assessment.

Corrections to this record
- 2026-10-20 Stated reason reclassified from OFFICIAL FORECAST to INTERPRETATION. The Citizen's Guide (printed page 7) lists nine objectives for the year's measures without tying each objective to a measure. Matching this objective to this measure is the register's reading, not the Ministry's statement. Previously: OFFICIAL_FORECAST.
- 2026-10-21 Law verification changed from verified to pending. The provision read, s. 3(5) of the current Act, makes operators liable for excise on access to over-the-top services, but the schedule item that imposed the UGX 200 daily charge was not read. The current wording is still shown, as the law in force now, not as the 2018 charge. Previously: verified.
- 2026-10-21 MTN Uganda Limited v URA, TAT Application No. 134 of 2023 ([2026] UGTAT 46) read from the author's copy; the case marked read with its holding, sourced, and the record's afterlife extended. The ruling decides how the daily charge on over-the-top access could be assessed, and records the size of the assessment set aside.
- 2026-10-21 Law verification changed from pending to verified: Act 9 of 2018 read, item 13(b) and s. 4(5). The schedule item that imposed the daily charge has now been read in the Act. Previously: pending.
